Items relating to the 1890 Union Pacific Depot purchase and landmark alteration
certificate:


1.
Introduction, first reading and consideration of an Ordinance authorizing
the city manager to enter into agreements related to the purchase of the
1890 Union Pacific Depot located at 2275 30
th
Street (the Depot); enter
into agreements to move the Depot; grant a rebate for the general fund
portion of the construction use tax for the redevelopment of the Crossroad
Commons PUD Amendment for the purpose of purchasing and moving
the depot; and implement the necessary steps to move the Depot;
2.
Consideration of a motion to open the public hearing related to a landmark
alteration certificate application to move the Depot; and
3.
Consideration of a motion to continue the public hearing related to the
landmark alteration certificate application for the Depot to the June 6,
2006 meeting.

The hearing on this item will be held under the quasi-judicial procedures of Chapter 1-3,

EXECUTIVE SUMMARY:
The purpose of this agenda item is for City Council to consider an ordinance approving the
rebate of the general fund portion of the construction use tax on the redevelopment of Crossroad
Commons Shopping Center, where the Boulder Jaycees Train Depot is located, and approving
the purchase of the Depot from the Jaycees. The item also includes Council consideration of a
Landmark Alteration Certificate approval by the Landmarks Preservation Advisory Board to
move the Depot to a new location with certain conditions. If the Council supports purchasing AGENDA ITEM #________PAGE________ 2
and moving the building, staff seeks Council direction on which of several possible moving
strategies to pursue.

The proposed redevelopment of Crossroad Commons provides an opportunity for the city and
the Jaycees, a non-profit organization, to realize a mutual, long-term goal of transferring
ownership of the Depot from the Jaycees to the city and relocating this historic landmark to a
more suitable setting. The city and the Jaycees have attempted to accomplish this on several
occasions since the mid-1980s. The owner of Crossroad Commons, Regency Retail Partners
(Regency), has offered to move the Depot from its shopping center parking lot to another
temporary or permanent location, to be selected by the city, provided this can occur by March
2007. Relocation of the Depot could facilitate substantial redevelopment of the center, enabling
successful retailers to expand, improving the safety and convenience of site access, and making
the parking lot more efficient. However, the logistics and costs associated with relocating and
restoring the Depot are significant challenges.

Key issues for this project include: the purchase of the Depot; a rebate of the general fund
portion of the Crossroad Commons redevelopment construction use tax; identification of the
relocation site for the building; the strategy for relocating the building; and the cost of and
funding for relocating and restoring the building.

STAFF RECOMMENDATION:
Staff recommends that the City Council open the public hearing on the Landmark Alteration
Certificate for moving the Depot and immediately continue the matter to the June 6, 2006
meeting, so that the certificate can be considered in conjunction with the second reading of the
ordinance regarding the Depot.

Staff recommends that the city purchase the Depot from the Jaycees so that it can be relocated.
In order to facilitate the relocation, staff recommends that the city rebate Regency the general
fund portion of the construction use tax on the redevelopment of Crossroad Commons, in return
for an agreement from Regency to pay for the first phase of moving the building. If the first
phase costs can be completed for less than $535,000, then Regency would pay the balance to the
city for use on subsequent phases of the project. The general portion fund of the construction use
tax is currently estimated to be approximately $156,000.

The new location and future use for the Depot will be determined through the Transit Village
Area Plan (TVAP) process. The TVAP design charrette scheduled for this May will explore
possible locations and uses. Once moved to its final location, the interior and exterior of the
Depot would be finished to serve the selected use.

Staff recommends that Council direct staff to decide upon the relocation strategy based on
certain conditions:

a. Move the building intact to a permanent location in the Boulder Transit Village area (Strategy
B or D with Note 6) if: AGENDA ITEM #________PAGE________ 3
- A permanent location for the Depot is determined through the TVAP and is available
(including any necessary land purchase) by March 2007 (at the earliest or such later time
as Regency needs the building moved), and

- Adequate funding is identified and pledged for moving the building and placing it on a
permanent foundation. (This generally corresponds to Phases 1 & 2 & land acquisition in
the Cost Estimates, Attachment B.)


b. Move the building intact to a temporary location near the permanent site or at the city-owned
site at 30
th
& Pearl (Strategy B, C, or D) if:

- A permanent location for the Depot is determined through the TVAP but it is not
available by March 2007 (at the earliest or such later time as Regency needs the building
moved), and

- Adequate funding is identified and pledged for moving the building, placing it on a
permanent foundation, and purchasing land (if necessary). (This corresponds to Phases 1
& 2 & land acquisition in the Cost Estimates, Attachment B.), and

- If the temporary location chosen is the city-owned site at 30
th
& Pearl, the building
could be removed by March 2008 (at the earliest or such later time as the site work on the
city-owned site necessitates removing the building).

c. Disassemble the building and store it at the city-owned former egg farm until a permanent
location and adequate funding are secured (Strategy A) if:

- A permanent location is not determined or not available by March 2007 (at the earliest
or such later time as Regency needs the building moved) and/or adequate funding is not
identified and pledged for Phases 1 & 2 & land acquisition.

Because it is anticipated that the funding provided by Regency will not be sufficient to complete
the move, restoration and preservation of the building, staff also recommends that the City
Council direct staff to seek additional funding for the project.

COUNCIL FILTER IMPACTS:
Economic: The Crossroad Commons Shopping Center houses several successful national
and local retailers. In fact, Whole Foods Market is one of Boulders top-performing
retailers in terms of local sales tax generation. The proposed redevelopment plan that
assumes the relocation of the Depot would almost double the size of the Whole Foods
store (to approximately 75,000 square feet), and would develop a new, two-story Barnes
& Noble store at the corner of 30
th
and Pearl Streets. These expanded retailers would not
only serve as strong anchors for the shopping center, they would also be key to ensuring
that other retail centers in the Boulder Valley Regional Center (BVRC) and the 28
th
/30
th

Street corridor remain viable into the future. Many national retailers desire locations in AGENDA ITEM #________PAGE________ 4
proximity to frequently visited stores such as Whole Foods. The four-screen movie
theater is proposed to be replaced to accommodate the reconfigured shopping center.
However, the 16-screen Century Theater is scheduled to open at Twenty Ninth Street in
early 2007.
